1. Acceptance of Terms

By accessing or using the website and services of the Tamil Traditional Martial Arts Education and Research Centre (“the Centre”, “we”, “us”, or “our”), you (“user”, “student”, or “participant”) agree to be bound by these Terms and Conditions (“Terms”).

If you do not agree to these Terms, please discontinue use of our website and services immediately. Your continued use of our services constitutes acceptance of these Terms.

These Terms apply to all users of the website, including students, visitors, and prospective students.

2. Services Provided

The Centre provides the following services:

  • Traditional martial arts coaching and training in Silambam, Varma Kalai, and Kuttu Varisai
  • Regular classes for various age groups and skill levels
  • Public demonstrations and cultural performances
  • Research and preservation of Tamil martial arts heritage
  • Workshops and special training programmes
  • Championship preparation and competition guidance

All services are subject to availability, instructor assessment, and the Centre's admission criteria. We reserve the right to refuse admission to any applicant or terminate the enrolment of any student at our discretion.

Enrolment in any programme does not guarantee continuation of services and may be suspended or terminated for violation of these Terms, non-payment of fees, inappropriate conduct, or any other reason deemed appropriate by the Centre.

3. Eligibility and Admission

To enrol in our training programmes, you must:

  • Be at least 5 years of age (minors require parental/guardian consent)
  • Be physically fit to participate in martial arts training
  • Provide accurate and complete registration information
  • Submit all required documentation, including medical fitness certificates if requested
  • Agree to and sign the liability waiver and consent forms

Parents or legal guardians must provide written consent for participants under 18 years of age and are responsible for ensuring their compliance with these Terms.

The Centre reserves the right to require medical clearance from a licensed physician before allowing participation in training activities.

4. Code of Conduct

All students and visitors are expected to maintain the highest standards of respect, discipline, and decorum consistent with Tamil martial tradition. This includes:

  • Respect: Show respect to instructors, fellow students, and the training facility at all times
  • Discipline: Follow all instructions given by instructors and adhere to training schedules
  • Safety: Use equipment properly and follow all safety guidelines
  • Hygiene: Maintain personal cleanliness and wear appropriate training attire
  • Punctuality: Arrive on time for classes and inform the Centre of any absences
  • Non-violence: Use martial arts skills only for self-defense and never for aggression

Prohibited conduct includes:

  • Disrespectful or abusive behavior toward instructors, staff, or fellow students
  • Use of martial arts techniques to harm others outside of supervised training
  • Consumption of alcohol, drugs, or tobacco on Centre premises
  • Theft, vandalism, or damage to Centre property
  • Unauthorized recording or photography of classes
  • Inappropriate or revealing clothing during training
  • Sharing of training techniques with non-students without permission

The Centre reserves the right to immediately suspend or expel any individual whose conduct is deemed inconsistent with the values of the tradition or disruptive to the learning environment. No refunds will be provided in cases of expulsion for misconduct.

5. Liability, Risk, and Insurance

Assumption of Risk: Martial arts training involves inherent physical risks, including but not limited to muscle strains, sprains, bruises, fractures, and other injuries. By participating in training activities, you acknowledge and accept these risks.

Liability Waiver: All participants are required to sign a separate comprehensive liability waiver prior to commencing training. This waiver releases the Centre, its instructors, staff, and affiliates from liability for injuries sustained during training.

Insurance: The Centre maintains appropriate liability insurance. However, participants are strongly encouraged to maintain their own personal health and accident insurance.

Limitations of Liability: To the maximum extent permitted by Indian law, the Centre shall not be liable for:

  • Injuries resulting from a participant's own negligence or failure to follow instructions
  • Pre-existing medical conditions aggravated by training
  • Injuries sustained outside of supervised training sessions
  • Loss or theft of personal belongings on Centre premises
  • Indirect, consequential, or punitive damages of any kind

Medical Emergencies: In the event of a medical emergency, the Centre will make reasonable efforts to provide first aid and contact emergency services. By enrolling, you authorize the Centre to seek emergency medical treatment on your behalf if you are unable to consent.

6. Fees and Payment Terms

Tuition Fees:Current fee schedules are available on our website and at the Centre. Fees are subject to change with 30 days' advance notice.

Payment Terms:

  • Fees must be paid in advance on a monthly, quarterly, or annual basis as selected
  • Payment is due on the first day of each billing period
  • Late payments may incur a late fee and suspension of training privileges
  • We accept cash, bank transfer, UPI, and other payment methods as displayed

Refund Policy:

  • Registration fees are non-refundable
  • Tuition fees are non-refundable after the first class of the billing period
  • Refunds may be considered in exceptional circumstances at the Centre's sole discretion
  • No refunds for voluntary withdrawal, absence, or expulsion for misconduct

Suspension and Reinstatement: Students whose accounts are more than 15 days overdue will be suspended from classes. Reinstatement requires payment of all outstanding dues plus any applicable late fees.

7. Intellectual Property Rights

All content on this website and in our training materials — including but not limited to text, photographs, videos, graphics, logos, training curricula, and educational materials — is the intellectual property of the Centre, Dr. N. Ramesh Aasaan, or our licensed contributors.

Copyright: All content is protected by Indian and international copyright laws. Unauthorized use, reproduction, or distribution is strictly prohibited.

Trademarks:The Centre's name, logo, and related marks are trademarks owned by the Centre. Use of these marks without written permission is prohibited.

Restrictions: You may not:

  • Copy, reproduce, or distribute any website content without written permission
  • Record, photograph, or videograph classes without explicit authorization
  • Teach or share Centre training methods outside of authorized contexts
  • Use Centre materials for commercial purposes
  • Modify, reverse engineer, or create derivative works from Centre content

Student Content: By participating in Centre activities, you grant the Centre a perpetual, royalty-free license to use photographs, videos, or testimonials featuring you for promotional purposes. You may opt out by providing written notice.

8. Privacy and Data Protection

The collection, use, and protection of personal data is governed by our Privacy and Cookie Policy and applicable Indian data protection laws, including the Information Technology Act, 2000 and the Digital Personal Data Protection Act, 2023.

Data We Collect: We collect personal information including name, age, contact details, emergency contact information, medical history relevant to training, payment information, and training progress records.

Use of Data: Your data is used for:

  • Administering your training programme
  • Communicating about classes, events, and schedule changes
  • Processing payments
  • Ensuring safety through emergency contact information
  • Improving our services
  • Sending promotional materials (with your consent)

Data Security: We implement reasonable security measures to protect your personal data. However, no electronic system is completely secure, and we cannot guarantee absolute security.

9. Website Use and Restrictions

Permitted Use: This website is provided for informational purposes and to facilitate registration for our services. You may browse and use the website for personal, non-commercial purposes.

11. Termination of Services

Voluntary Termination: You may terminate your enrolment at any time by providing written notice to the Centre. Fees paid for the current billing period are non-refundable unless otherwise specified.

Termination by the Centre: We reserve the right to terminate your enrolment immediately and without refund if you:

  • Violate these Terms or the Code of Conduct
  • Fail to pay fees when due
  • Engage in conduct that endangers others
  • Provide false or misleading information
  • Cause disruption to classes or operations

Effect of Termination: Upon termination, you must:

  • Return all Centre property, including training equipment
  • Settle any outstanding financial obligations
  • Cease representing yourself as a student of the Centre
  • Cease using Centre intellectual property

12. Governing Law and Dispute Resolution

Governing Law: These Terms shall be governed by and construed in accordance with the laws of India, without regard to conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Tamil Nadu, India.

Dispute Resolution: In the event of any dispute arising from these Terms or your use of our services, the parties agree to first attempt resolution through good-faith negotiation.

Arbitration: If negotiation fails, disputes shall be resolved through binding arbitration in accordance with the Arbitration and Conciliation Act, 1996. The arbitration shall be conducted in Tamil Nadu, India, in the English language.

Exceptions: The Centre reserves the right to seek injunctive or equitable relief in court for breaches related to intellectual property, confidentiality, or safety concerns.

13. Miscellaneous Provisions

Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Waiver:The Centre's failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision.

Entire Agreement: These Terms, together with our Privacy Policy and any separate agreements signed by you, constitute the entire agreement between you and the Centre regarding the subject matter herein.

Assignment: You may not assign or transfer your rights under these Terms. The Centre may assign its rights and obligations without restriction.

Force Majeure: The Centre shall not be liable for any failure to perform its obligations due to circumstances beyond its reasonable control, including natural disasters, government actions, pandemic, war, or other force majeure events.

Language: These Terms are written in English. Any translations are provided for convenience only. In case of conflict, the English version shall prevail.
